“Making A Murderer” struck a chord with viewers when it hit Netflix last year, and brought national attention to the questionable circumstances around which Steven Avery and his then 16-year-old nephew Brendan Dassey came to be convicted raping and murdering a woman who visited the family auto yard.
Now, Brendan may walk free. His legal team was able to prove that he was recklessly coerced into a confession and — barring a retrial — could be released back into the world as a free man within the next 90 days. Via Mashable:
A federal court in Wisconsin on Friday overturned the conviction of a man found guilty of helping his uncle kill Teresa Halbach in a case profiled in the Netflix documentary Making a Murderer.
The U.S. District Court in Milwaukee overturned Brendan Dassey’s conviction and ordered him freed within 90 days unless prosecutors decide to retry him. A spokeswoman for the state Department of Justice, which was handling the case, did not immediately return a message seeking comment.
Magistrate Judge William Duffin said in Friday’s ruling that investigators made false promises to Dassey by assuring him “he had nothing to worry about.”
“These repeated false promises, when considered in conjunction with all relevant factors, most especially Dassey’s age, intellectual deficits, and the absence of a supportive adult, rendered Dassey’s confession involuntary under the Fifth and Fourteenth Amendments,” Duffin wrote.
The ruling comes after Dassey’s appeal was rejected by state courts. Dassey confessed to helping his uncle Steven Avery carry out the rape and murder of Halbach, but attorneys argued that his constitutional rights were violated throughout the investigation. Dassey was 16 when Halbach was killed in 2005 after she went to the Avery family auto salvage yard to photograph some vehicles.
“Today there was a major development for the subjects in our story and this recent news shows the criminal justice system at work,” the directors said in a statement. “As we have done for the past 10 years, we will continue to document the story as it unfolds, and follow it wherever it may lead.

Trump aka “Loose Lips” may be in a bit of trouble if polls continue to trend this way. It looks like Clinton is leaping ahead of him according to polls in key battle ground states. Clinton leads in Colorado, North Carolina, Florida, Iowa and Ohio over Trump by as much as 9% according to ABC.
Democratic presidential nominee Hillary Clinton has built up a significant lead in several crucial battleground states, according to new NBC/WSJ/Marist polling released today.
Clinton has generated double-digit margins in Virginia and Colorado with 13-point and 14-point advantages over Trump, respectively.
The poll also showed Clinton with leads over Trump in Florida and North Carolina. In the Sunshine State, Clinton has a 5-point edge among registered voters. In North Carolina, Clinton enjoys a 9-point advantage.
Losses in these states could be devastating for Trump. The Republican nominee’s clearest path to the White House requires wins in Ohio and Florida, where Hillary Clinton has a slight lead, as well as North Carolina and Pennsylvania, where he trails by a broad nine percentage points.

A new reality show on MTV is tackling the shocking epidemic of wrongful convictions – and its disproportionate impact on the black community.
“Unlocking The Truth” follows Ryan Ferguson, who spent a decade in prison for a murder he did not do, and investigator Eva Nagao as they uncover new evidence in crimes where the defendants were convicted under questionable circumstances.
“This is something that is very real,” Ferguson told BOSSIP. “It could happen to anyone at any time.”
There are about 2.3 million people in prison, and a little less than half are black men, according to the Bureau of Prisons. Of the number of incarcerated, the show estimates there are as many as 60,000 innocent people who are currently locked up.
Ferguson himself was convicted of murder and spent his 20s behind bars, until witnesses in his case recanted. He filed an appeal, and a judge ordered him released. He now has a lawsuit pending against the prosecutors and law enforcement who pushed for his conviction.
“Somebody right now is going through what I went through,” he said. “This happens to poor people, and there are racial issues as well.”
Ferguson’s co-star, Nagao agreed, and said the public is interested in police accountability, especially after several recent incidents of police shooting unarmed black men.
“I think it speaks to broader issues that people are interested in,” she said, “and highlights the systemic failures that there are.”
The first episode sees Ferguson return to the same Kansas City, Mo. prison he’d been locked up in to visit Michael Politte, a man who said he was wrongly convicted of bludgeoning his mother and setting her on fire when he was just 14 years old. Ferguson said he planned to continue his work around wrongful convictions as long as he could because in helping others, he was helping himself.
The show’s goal is to use individual cases to expose the system-wide failures within the criminal justice system – and its unequal burden on the black community, said Andrew Jenks, the show’s executive producer.
“The judicial system is f**ked, needs major overhaul,” Jenks said, “and if we can play a small part in making a difference, that’s awesome.”
“Unlocking The Truth” premieres Aug. 17 at 11 p.m. on MTV.
Birth Of A Nation’s Nate Parker sat down with Variety and addressed some really sensitive questions regarding a rape allegation he faced in college. The interesting part of it is that his writing partner on the film was also his college roommate and also charged but convicted of rape. Nate was a little luckier, we guess. Yikes!
In 1999, as a student and wrestler at Penn State University, Parker and his roommate Jean Celestin were charged with raping a 20-year-old female student in their apartment after a night of drinking.
“Seventeen years ago, I experienced a very painful moment in my life,” Parker told Variety. “It resulted in it being litigated. I was cleared of it. That’s that. Seventeen years later, I’m a filmmaker. I have a family. I have five beautiful daughters. I have a lovely wife. I get it. The reality is” — he took a long silence — “I can’t relive 17 years ago. All I can do is be the best man I can be now.”

At the time, Parker admitted he had sex but claimed it was consensual. The woman said that she was unconscious, and did not consent to having sex with Parker or Celestin. She also claimed that she was stalked and harassed by Parker and Celestin after she reported the incident to the police.
Parker was suspended from the wrestling team, and later transferred to a different college in Oklahoma. In a 2001 trial, he was acquitted, based on testimony that he had previously had consensual sexual relations with his accuser. But his roommate was found guilty and sentenced to six months in prison. Celestin appealed the verdict, and a second trial in 2005 was thrown out due to the victim not wanting to testify again. (She sued the university and was awarded a $17,500 settlement out of court.)
Sounds SUPER messy and reminds us of another high profile rape case currently in the news.
SMH @ the irony of a wrestler being accused of tag teaming a woman BUT we do think the fact that Parker was an athlete may have played a role in how this whole thing played out.
The question is — how does this change (or not change) how we look at him now? People can change and 17 years is quite some time but time hasn’t made that much difference when it comes to the crimes allegedly committed by Woody Allen and Roman Polanski, or even R.Kelly. Granted the victims in those cases were children.

Daryl Homer, the son of a single mother from the Virgin Islands who became fascinated by fencing when he saw a picture of two fencers in a children’s dictionary at the age of 5, became the first American to win a silver medal in men’s individual sabre in 112 years Wednesday night at the Olympic Games.
Homer, 26, the 2015 world silver medalist who is ranked 10th in the world, lost the gold medal match to longtime rival Aron Szilagyi of Hungary, 15-8. Szilagyi also won the gold in London four years ago, where Homer finished sixth.
“I’m just very, very pleased,” Homer said. “Just happy to be on the podium, happy that I competed, happy that I left it all out there. I think I just overthought the match a little bit, got a little of the heebie-jeebies.”
Homer became the first U.S. man to win an Olympic medal in individual sabre since Peter Westbrook, who won the bronze at the boycotted 1984 Los Angeles Olympics. Like Westbrook, Homer is black, a rarity in the sport.
An American has never won a gold in men’s individual sabre. William Grebe, a Chicagoan who was born four years after the Civil War ended, won a silver in 1904. He died in 1960.

Elite swimmer Michael Phelps says he’s finally ready to retire after becoming the most winningest Olympic athlete of all time according to TMZ:
Michael Phelps just officially crushed the hopes of anyone hoping to see him swim in Tokyo for the 2020 Summer Olympics … announcing his retirement from the games (again).
Phelps was doing a livestream with fans Saturday and the question of his return to the games for 2020 came up. This time, Michael was adamant … he’s not coming back.
It’s not the first time Phelps has called it quits — he “retired” in 2012 after the games in London — but this time, it seems legit.

An Iowa mother has been is facing child endangerment charges after her toddler son was found home alone Monday.
Hallie Amick, 30, of Des Moines, was charged with child endangerment bodily injury and narcotics possession schedule I. She is being held in the Polk County Jail pending bail of $3,000.
Police reported that when they arrived at the home they found the 2-year-old boy in the backyard alone wearing only a T-shirt and a diaper that was “full and sagging.”
The child was sucking on a frozen chicken breast while a small dog was jumping on the boy trying to get the chicken, according to the police report.
A neighbor reported that the boy is left home alone all the time. The neighbor also reported she had seen the boy alone in the backyard a lot with the dog who has bitten him.
Police reported that when the mother returned home she lied to them saying it was the first time she has left the child alone. When questioned, police said the mother later “admitted she has left (the boy) home alone on occasions.”
A neighbor reported finding the boy alone in the middle of the street when they first moved in, saying they don’t watch him very well.
