Henry Davis Wins Appeal To Continue Brutality Lawsuit Against Ferguson Police

A Missouri man who said he was mistaken for a criminal, beaten by Ferguson cops and charged for bleeding on their uniforms can now continue his lawsuit over the alleged assault — nearly six years after the incident, a court ruled Tuesday.

Henry Davis, 53, won a federal court appeal to reinstate his suit claiming three Ferguson officers violated his rights and used excessive force during a brutal 2009 arrest.

His case got halted last year when a judge said his injuries weren’t severe enough to prosecute the police officers — despite a booking photo that shows Davis bleeding from his head.

Davis was stopped for speeding and arrested for allegedly driving while intoxicated in Sept. 2009, according to the St. Louis Post-Dispatch. After struggling with officers when they tried putting him in an occupied jail cell, their fight turned violent, leaving David bloodied and one of the officers with a broken nose.

Davis said in his suit, initially filed in 2010, that he was wrongly arrested after police confused him with another Henry Davis, and that he was beaten “without provocation while he was handcuffed on the ground.” The officers countered that Davis was drunk during his arrest and started the fight. They also charged him with property damage after he bled on them.

Tyler Perry Offers To Pay For Bobbi Kristina’s Funeral

Tyler Perry is publicly reacting to the death of Bobbi Kristina Brown, the daughter of his close friend, the late singer Whitney Houston.

“He has told the families that he will help ‘take care of everything,'” a source reportedly told ‘ET.'” … Including offering use of his private jet to transport Bobbi Kristina’s body from Atlanta, where a funeral service is planned for Saturday, to New Jersey, where she will be buried alongside Houston.”

Bobbi Kristina’s death came one week after Perry took to Facebook to defend the Houston and Brown families amid rumors that were running rampant in the media.

“This morning I woke up with Whitney on my mind. I couldn’t help but think about all that she must have dreamed for her child,” Perry wrote. “I know this was not her dream. … And as difficult as this time is for the people who love both Whitney and Krissi, what makes it more egregious is the blatant disrespect, lies, and ignorance that are rapidly printed in this awful time.

“For some reason, it has become human nature in our society to look for, seek out, and celebrate darkness, glory in tragedy, and enjoy reading and reporting it. It makes me sad to know that everybody wants to be the first to report something awful,” Perry’s Facebook post reads. “So much so, that they find it OK to speak death onto those who are still alive. May I ask you all to please show some decency and respect?”

While Perry asked people to pray for Bobbi Kristina and her family until they officially announced her death, that day came on Sunday.

Rapper Jay Z and Beyonce Knowles are reportedly expecting their second child together. It has been rumoured that she has conceived through in vitro fertilization (IVF).

The couple, who already have three-year-old daughter Blue Ivy together, are feeling incredibly “lucky” over their apparent impending arrival, reports femalefirst.co.uk.

“They’ve been trying for a while, and it was so hard when it wasn’t happening. They both desperately wanted another child and feel so lucky. But they definitely won’t tell everyone with just a statement, that’s not their vibe,” a source told OK! magazine.

The “Drunk in love” hitmaker is also believed to be worried about “jinxing” things by revealing they are expecting ahead of the first trimester.

The source added: “Even though she’s barely showing, she’s paranoid that someone will pick up on it, so she’s hiding her stomach whenever she goes out.

“They’ve gone through so much to get here that they don’t want to jinx it by telling everyone before the three-month mark. They’d love to involve Blue, because they know how much she wants a little brother or sister.”

Confederacy-Lovers In Harass And Call Black Army Vet The N-Word

In 2005, a family bought what they thought was their “forever home” on four acres in Millington. But after harassment started, three months felt like an eternity. And now 10 years later, it still hasn’t stopped.

Staff Sergeant Briscoe is a 17 year veteran of the Army, and it’s there that she learned to adapt and overcome. Her ongoing battle against racism is now being fought in her very own front yard.

Broken glass, bags of trash and even bottles filled with urine have been picked up. Briscoe wants it all to end. It’s been a decade of harassment, simply because of the color of her skin.

“We get flipped off; we get called racial names, but Saturday when my son was out there and with the race relations being so high, I just know I needed some evidence in case something happened,” Briscoe said.

That day, a pick-up truck with confederate flags flowing from the back drove by her home.

“As they were slowing down driving by us they shouted out ‘M-F N-word.’”

Briscoe took pictures, and the Shelby County Sheriff’s Office identified two of the suspects in a police report.

FOX13 contacted the Sheriff’s Office to see what’s been done. They responded with this email saying in part, “We are investigating the individual’s involved. We do not condone this type of behavior or the disrespect of any individuals.”

The new crew showed Briscoe a copy of the email but he wasn’t very impressed…

“That sounds good, but what other actions are they gonna take? You know something needs to be done now.”

FOX13 asked Memphis attorney Jennifer Fitzgerald about Briscoe’s legal rights. In regards to the alleged racial comment made towards Briscoe’s son, it could be considered freedom of speech.

But if that speech meets the criteria for harassment, then it is not protected speech. Harassment is defined as communication with another person with the malicious intent to frighten, intimidate or cause emotional distress.

Fitzgerald told FOX13 if Briscoe can prove it is the same person making these threatening remarks or gestures, she may have the grounds to get an order of protection.

Fitzgerald suggests Briscoe gather more evidence by getting a camera and documenting each situation. More than one documented crime could be considered stalking, which a more serious offense.

Confederate Flags Found At Ebenezer Baptist Church And King Center

Several Confederate flags and were found near the iconic King Center and Ebenezer Baptist Church this morning in Atlanta.

According to Ebenezer Baptist Church Rev. Shanan Jones, police and Homeland Security are working to remove the flags.

Atlanta police confirms four small flags were found laying on the property.

The flags were placed below a poster that states “Black lives matter, hands up,” by a garbage can, on the path the historic MLK site and on the corner near the church, according to the Atlanta-Journal Constitution.

The church plans to make a statement later Thursday morning.

Ebenezer Baptist Church consists of Martin Luther King, Jr.’s boyhood home and the original Ebenezer Baptist Church, the church where King was baptized and both his father, Martin Luther King, Sr., and he were pastors.

Hulk Hogan Uses The ‘N-Word’ With His Son Nick

Hulk Hogan is caught up in another racist scandal after getting caught using the ‘n-word’ with son Nick on a leaked audiotape…

It seems that the n-word was a regular part of Hulk Hogan’s vocabulary. He didn’t just use it when he was mad, or speaking disparagingly of African Americans.

Looks like he also used it the way some black people do: endearingly. Except the problem is, well, he’s not black.

According to the Daily Mail, more audiotapes have been leaked, and in them Hogan can be heard using the n-word during a phone conversation he was having with his son, Nick Bollea, who was in jail at the time in Florida.

“You and me been sitting on some serious phone, phone dialogue here, n–ga,” Hogan said to his son in May 2008.

Bollea used a variation of the n-word, too, replying, “Yeah, nibbah.”

Hogan even spoke about how he’s using the n-word, telling his son that when he does use it, it’s to express a kinship.

“N–ga, n–ga, that means, that means you my best friend,” Hogan reportedly says in the recording.

Kennel Owner Sentenced For Cutting The Tails Off 8 Puppies

A now-former Georgia kennel owner has been sentenced to five years probation for cutting the tails off at least eight puppies, one of which died.

According to a news release from the Gwinnett County Solicitor’s Office, Leslie Ayo pleaded guilty Monday to five counts of animal cruelty and one count of practicing veterinary medicine without a license. In addition to probation, she was sentenced to pay a $3,500 fine, perform 240 hours of community service, surrender all kennel-related licenses and have no contact with animals.

Ayo was operating Heaven’s Gate Kennels when, in November 2013, a Lawrenceville family hired her to dock the tails and remove the dewclaws of their eight rottweiler puppies, officials said. Ayo reportedly charged $150 for the service and used scissors to perform the procedures.

“All of this was done without anesthesia or pain medication,” the Gwinnett solicitor’s office said in an emailed statement.

The 10-day-old dogs began hemorrhaging, officials said, and their owners took them to a veterinarian. One of the puppies later died.

Ayo did not have a veterinary license. Under Georgia law, only licensed veterinarians can perform docking procedures, and even then dogs must be between three and five days old.

Ayo was arrested in the case on March 13, 2014, and released the next day on $11,700 bond.

Kansas City Adams Mark Worker Files Complaint After Supervisor “Lynched” Slave Doll In Entrance To Her Office

According to KSHB Kansas City reports:

Jaysyn Craddock is a front desk assistant at the Adam’s Mark Hotel. He explained to 41 Action News that he was working on July 21, when his supervisor hung the black doll from the noose and asked him to come and look at it.

“So she looked at me and said, ‘Look what I hung up,’ in a giggling way and she asked me, ‘Does this offend you?’ She didn’t say ‘I’m sorry,’ she said ‘Does this offend you?’ And I didn’t say anything. I was just so upset that I went back to helping people and she left it up until the end of the night,” Craddock said.

Later, Craddock and some co-workers complained to the front desk manager.

“It’s embarrassing. It’s humiliating. Like I felt like that no actions were going to be taken, because our front desk manager spoke to all of us individually and she asked us if we wanted to speak to the person who hung up the doll and we all said yes. She said something to us individually; but she said after you speak with my supervisor, I don’t want to hear anything about it,” Craddock added.

Adams Mark Hotel later fired the supervisor. A statement from the hotel said the supervisor “hung a slave doll using a plastic bag as a noose and displayed the doll in an employee common area.” A photo of the doll has been circulating on social media sites since July 22, according to the attorney.

Craddock’s attorneys have filed a complaint with the Equal Employment Opportunity Commission. If the EEOC gives them the green light, Craddock’s attorneys will be able to sue the Adam’s Mark Hotel for harassment.

The hotel has since released the following statement:

“This isolated incident is completely inconsistent with the values and culture of the Adam’s Mark Hotel Kansas City. This disturbing occurrence took place late Tuesday evening, July 21st. When brought to the attention of management the following day, an investigation was initiated. Immediately following the investigation, the employee was terminated, Friday, July 24th, prior to the start of their next shift. The Adam’s Mark Kansas City is committed to maintaining a positive working environment free of unlawful harassment.”
